Introductory Memo
The Ministry of Home Affairs on June 22, 2026 notified the Foreign Contribution (Regulation) Amendment Rules, 2026. It amended the FCRA Rules of 2011. The changes sharpen accountability, tie registration to the pre-stated activities and area of operation, and introduce new compliance requirements for organisations receiving foreign funds. An important feature of the latest amendments is the bar on foreign nationals from being ‘key functionaries’ in non-profits or NGOs. Mandatory reporting of activity logs and social media accounts is another vital feature of the amendments. This has caused quite a flutter and an intense debate is unfolding on social media, with some supporting the amendments and some raising opposition to these. Against this backdrop, it becomes necessary to understand the amendments, without taking either of the sides.
